Why Consider Mediation?
Mediation is an alternative to a contentious, expensive, prolonged battle in the court system. Mediation is typically non-binding and affords the participants the opportunity to meet in a structured and controlled setting to work with the assistance of a mediator to work towards resolution of the issues that have created conflict between the parties. If the mediation is successful, the mediator will prepare a Memorandum of Understanding that can then be taken to the parties separate attorneys to be incorporated in a settlement document to be filed in the court, or if the parties are not represented by counsel, they can use the memorandum of understanding as the basis for their presentation of the agreement to the Court for approval and incorporation into the Court's final Judgment.
